These Terms of Use govern your use of medisurplusllc.com and any purchase from, or sale to, MediSurplus LLC. By using our website, submitting a form, or doing business with us, you agree to these Terms.

1. Who we are

MediSurplus LLC is a Georgia limited liability company. We buy surplus and overstock medical supplies, including diabetic supplies, from individuals and businesses ("Sellers"). We resell them to qualified buyers ("Buyers").

2. Eligibility

You must be at least 18 years old and legally able to enter a contract. If you act for a business, you confirm you have authority to bind that business.

3. Sellers: selling supplies to us

  • Ownership. You confirm you own the supplies and have the legal right to sell them.

  • Lawful source. You confirm the supplies were obtained lawfully. You are responsible for knowing whether your insurance plan, Medicare, Medicaid or any other program limits the resale of supplies it paid for.

  • Condition. Supplies must be unopened, unused, in original sealed packaging, undamaged and not expired. We may set minimum expiration requirements for each product.

  • Quotes. Any price we quote depends on our inspection of the supplies when we receive them. We may adjust or decline an offer if items do not match your description.

  • Rejected items. Items we do not accept may be returned to you at your cost or disposed of, as agreed at the time.

  • Payment. Once your supplies pass inspection, we pay by Zelle, Cash App, Venmo, check, Apple Pay or cash, as agreed with you.

4. Buyers: buying supplies from us

  • Product availability, quantities and pricing may change without notice until an order is confirmed.

  • Orders are confirmed only when we accept them in writing (including by email or text).

  • Payment is due as agreed before shipment, unless we agree other terms in writing. We accept Zelle, Cash App, Venmo, check, Apple Pay and cash.

  • Buyers are responsible for complying with all laws that apply to their purchase, storage and resale of medical supplies.

  • Product warranties are described only in our Warranty Policy.

5. Shipping and risk of loss

Shipping method and cost are agreed for each transaction. For Sellers, risk of loss stays with you until we receive the package, unless we provide a prepaid insured label. For Buyers, risk of loss passes to you when the carrier delivers the order.

6. Prohibited conduct

You agree not to:

  • Sell or offer us stolen, counterfeit, tampered, expired or recalled products.

  • Give false information about yourself, your supplies or how you obtained them.

  • Misuse the website, including attempts to hack, scrape or disrupt it.

    We may refuse or cancel any transaction we believe breaks these Terms or the law.

7. Not medical advice

Nothing on our website is medical advice. Always consult a licensed healthcare provider about medical products and their use.

8. Intellectual property

The content on this website, including text, logos and graphics, belongs to MediSurplus or its licensors. You may not copy or use it without our written permission. Product names and brands belong to their respective owners. MediSurplus is not affiliated with or endorsed by any manufacturer.

9. Disclaimer of warranties

Except as stated in our Warranty Policy, the website and all products are provided "as is" and "as available," without warranties of any kind, to the fullest extent allowed by law.

10. Limitation of liability

To the fullest extent allowed by law, MediSurplus is not liable for indirect, incidental, special or consequential damages. Our total liability for any claim is limited to the amount paid in the transaction that gave rise to the claim.

11. Indemnification

You agree to defend and hold harmless MediSurplus from claims arising from your breach of these Terms, your misuse of products, or false statements about supplies you sell to us.

12. Governing law and disputes

These Terms are governed by the laws of the State of Georgia. Any dispute will be resolved in the state or federal courts located in Atlanta, Georgia, and you consent to their jurisdiction.

13. Changes to these Terms

We may update these Terms at any time. The "Last updated" date shows the latest version. Continued use of our website or services means you accept the updated Terms.
